The Football Association and FIFA are set to be called in to broker a solution to the Carlos Tevez affair.



The Argentina striker's proposed move to Manchester United has been blocked after the Premier League ruled West Ham must receive the vast majority of the £30million-plus fee.


But West Ham are not in a position to handle the transfer because Tevez's economic rights are owned by businessman Kia Joorabchian.


Manchester United have agreed terms with Tevez and Joorabchian and hoped to have everything tied up last week - but the deal has now reached an impasse.


It is understood some of those involved in the negotiations do not believe the Premier League can act as independent arbiter in the case any longer.


And Tevez's representatives are set to request help from the FA and FIFA - the two bodies who oversee transfers at a domestic and international level. It is understood any such move would be endorsed by Manchester United, who are anxious to get a deal finalised.


A source close to the negotiations told PA Sport: 'Diplomatic moves are being made. We are in deadlock and we need an independent body to try and sort this mess out.


'The lawyers all agree Manchester United and Joorabchian are within their rights to do a deal - but the Premier League are saying they can't.


'The Premier League seem to have a vested interest now. They are covering their own backs after allowing West Ham to continue playing Tevez last season.


'Their whole argument is built on the premise West Ham tore up Tevez's contract and claimed to control the player.


'But any court in the land will tell you they cannot do that.'


The recent Premier League arbitration found West Ham's actions in declaring all ties had been severed 'may not have been legally watertight'.


Manchester United and Joorabchian are at a loss to understand why the Premier League are blocking Tevez's move when they sanctioned Javier Mascherano's transfer from West Ham to Liverpool in January.


Both players were on identical contracts at Upton Park and it is understood United want to sign the same deal for Tevez that Liverpool agreed with Joorabchian for Mascherano.


The Premier League's argument is that Mascherano had left West Ham before the independent commission's inquiry into the duo's initial move to West Ham from South America, which deemed the pair's contracts to be in breach of regulations.


West Ham were fined £5.5million but 'satisfied' the Premier League they had terminated the third party agreement in Tevez's contract.


As a result the Premier League allowed Tevez to play in West Ham's last three matches of the season, when he played a key role in the club's successful battle against relegation.


Having accepted Tevez was now controlled by West Ham, the Premier League were compelled to state the club had to conduct the transfer.


To accept Joorabchian retains control of the player would not only be a major climbdown but could result in legal action from Sheffield United, who felt they were unfairly relegated.


Unless FIFA or the FA can help manufacture a breakthrough, the matter would appear to be heading for the courts.



Not sure if you've been following the case of who really owns Carlos Tevez contract ?

Is it WetSpam (as supported by the EPL) or Joorabcian (the guy who Manure appear to have agreed terms with). Question

What does this all mean for Sheffield United ?

It's brilliant. I've been following it closely. Interesting to see what happens now Man Utd are involved.

The FA dug a hole the minute they accepted West Ham statement about cancelling the contract with Joorabchian. Excuse me, but don't both parties have to agree to terminate a contract.

Joorabchian must have evidence that would be damaging to West Ham.

West Ham have the support of the FA, who argue West Ham should keep the bulk of any transfer money. Now if you were West Ham and it was clear Tevez wants to go, wouldn't you be sanctioning the transfer to obtain a very tidy profit ????

Someone is about to open a can of worms.

West Ham warned they will be punished if Tevez walks away

West Ham have been warned by the Premier League that they face disciplinary action - which includes the option of a points deduction - if the dispute over the proposed transfer of Carlos Tevez to Manchester United is not concluded to their satisfaction.
The Premier League believes that West Ham have severed all links to Tevez's agent, Kia Joorabchian, who owns the economic rights to the player, and if the club agree to terminate the remaining three years of the Argentina striker's contract - something he has requested personally - sanctions will be imposed.

A Premier League spokesman said: "We have made it clear to West Ham that we will take action against them if they agree to Tevez's request to terminate his contract."
The league is unhappy at the prospect of Joorabchian being the main beneficiary of a deal with Old Trafford, after being given assurances this year that West Ham, who own the player's registration, had cut all ties with the businessman and his company, MSI.

"We are satisfied the agreement between West Ham and MSI no longer exists. Joorabchian says it does. The only way MSI can proceed is to sue West Ham for breach of contract," said the league spokesman.

In a related issue, Joorabchian is prepared to hand over all the documentation relating to Tevez's contract at West Ham if tomorrow's high court ruling goes in favour of Sheffield United. The relegated club are pursuing legal action after the Premier League inquiry decided not to dock West Ham points for breaking two regulations in their signing of Tevez and his fellow Argentinian Javier Mascherano.


It just gets better and better...............

The Premier League officials have to be the most naive group of idiots on the planet.

Did they not bother to check with Joorabchian if this was true ???

Any sympathy West Ham might have held with the "wasn't this regime" argument has completely disappeared with the way they've conducted themselves. What they should have done is immediately released Tevez or refused to play him the moment details of the contract came to light.

The other plus side of this entertainment is that if Manure really do shell out 30M+ for Tevez, they'll leave Berba alone.

While I hope we'll see Berba playing for Spurs for many many years to come, the day he leaves, I'd much much rather see him go to Barcelona or Milan, than any other EPL Club.

Was great reading his interview in The Sun today. Top man! Wink

This whole Worst Spam, EPL, Carlos "Pikey" Tevez affair is a complete farce. In any other industry this would have been up before a regulator, quicker then the spammers slide down the league last season. What amazes me is the complete lack of transparency in this and other transfers. Quite frankly it's disgusting.

Sheffield Utd must be gutted. I feel for them. Hoping the High Court may overturn the recent decision by the tribunal.......but unlikely.

Ezza - I agree. Tevez camp are rightly arguing the PL can no-longer act as a neutral arbitrator. They have thrown their support behind West Ham and dug a hole for themselves.

Pressure mounted on West Ham United last night after documents presented in court appeared to show that the club had entered into a second agreement with the owners of Carlos Tévez.

On a dramatic day in the High Court, Media Sports Investments (MSI) and Just Sports Inc (JSI) produced the contract that was signed by West Ham after the club’s new Icelandic owners had taken control in late November.

The contract made amendments to the original third-party deal agreed last summer when Tévez and Javier Mascherano arrived at Upton Park. The new agreement, dated December 1, was signed by Scott Duxbury, the club’s deputy chief executive who was legal director at the time, and Kia Joorabchian, who fronts MSI and JSI, and Tévez.

The revelations could be significant because the Premier League’s independent commission said that one reason for not deducting points from the club was because the new owners should not be penalised for the misdemeanours of a previous regime.

It is believed that West Ham sought changes to the initial agreement because it gave MSI and JSI the option of paying the club £100,000 to move Tévez in the summer.

West Ham initially claimed in court yesterday that the contract was not what it appeared to be. However, when the judge asked whether the club believed that it was a forgery, the club’s lawyers said no, but claimed that they had reservations about Tévez’s signature and the date on the copies of the documents.

The club claimed, outside court, that the contract had not been executed because they had not received copies of the countersigned agreements. The club added that the documents were supplied to the commission, which took them into account when it imposed a fine of £5.5 million in April for a breach of Premier League rules.

The saga appears set to be resolved soon after the court said that it will hear the case on August 22, for three days. MSI and JSI issued a writ against West Ham last week, seeking the court’s intervention to the club to release the registration of Tévez in accordance with their contract. “If a settlement is not possible then the club will present a robust legal case to the High Court,” West Ham said.

If Wham have lied theres only a week left until the start of the season - there's no way anything could happen to send them down. UNLESS they have a massive points reduction then it could be great

I read a while ago that Wham and Sheffield Utd have matching fixtures or something liek that, so if it came to it it wouldn't be that hard to switch the two. No idea if there's any truth in that, but it's what I heard.
